TRIPARTITE DIFFICULTIES IN INDONESIAN INDUSTRIAL RELATIONS CREATING HARMONY

The task of the Indonesian state is not only to create jobs, but the state must also ensure that in every employment relationship, all parties, especially workers/laborers, receive a decent standard of living as human beings and are treated fairly. A common problem faced in the business world is that employees' rights are not granted in accordance with regulations and the 1945 Constitution, namely the right to a decent standard of living and income. This research was conducted based on the numerous problems between entrepreneurs, the government, and employees. The data used to address the problem is collected using a legal approach and a case study approach. The research results explain that the characteristics of the employment relationship in Indonesia are still in the form of a subordinate relationship between employers and workers, one of the reasons being the still unbalanced bargaining power of workers.
