THE ROLE OF THE ADMINISTRATIVE JUDICIARY IN PROTECTING PUBLIC NATIONAL PROPERTY UNDER ALGERIAN LAW

This study examines the role of the administrative judiciary in protecting public national property under Algerian law. It first explains the legal basis for administrative jurisdiction in disputes concerning such property. It then identifies the bodies that are legally authorized to defend it before the courts. The study also addresses the main forms of judicial protection. These include disputes over ownership of public property, compensation for damage, failure to perform maintenance duties, and the collection of fees and royalties. It further considers disputes concerning deeds of notoriety and the scope of interim administrative relief in protecting certain categories of public property. The study concludes that the administrative judiciary plays an important role in giving practical effect to the legal and judicial protection of public national property and in preserving it.
