ELECTRONIC LITIGATION UNDER THE NEWLY ENACTED PROCEDURAL LAWS

Electronic litigation represents a fundamental transformation and a comprehensive digitization of the contemporary justice system in Algeria. It has moved the judicial function away from the traditional paper-based model built on physical attendance, toward an interactive digital environment that relies on information and communication technology to manage and register cases, exchange memoranda, and hold hearings through remote video-conferencing technology. The Algerian legislator has entrenched this orientation through Law No. 15-03 on the modernization of justice, the amendment of the Code of Civil and Administrative Procedure (Law 22-13), and the new Code of Criminal Procedure (Law 25-14), establishing the legal and technical conditions needed to guarantee the evidentiary value of electronic transactions and signatures and to protect the personal data of the parties involved. This newly developed system aims to make efficient use of time, shorten procedures, ease the burden on the courts, and achieve prompt justice with a high degree of efficiency, thereby laying the foundation for an integrated digital judiciary that overcomes the geographic, temporal, and financial obstacles facing litigants.
