DESAFIOS PARA A CONCESSÃO DE PATENTES A SISTEMAS DE INTELIGÊNCIA ARTIFICIAL: UMA ANÁLISE A PARTIR DE DABUS

This work seeks to analyze in an exploratory way how inventions originating from Artificial Intelligence systems should be legally treated, considering whether or not the granting of patents to such systems is due or not. This is a topic that is bubbling up due to the constant and rapid advancement of the application of Artificial Intelligence systems. Thus, the pros and cons of granting patents to inventions created by Artificial Intelligence were analyzed. For this purpose, this work will use the dialectical method, raising as a thesis the possibility of granting patents to inventions created by AI, and as an antithesis, points contrary to the concession were analyzed. As a procedure we used the monographic research, and the research technique was the bibliography. As a summary of the research, the impossibility of protecting inventions and utility models created by artificial intelligence systems was discovered, but there was a vast field that deserves attention. It was noticed that this is a field that is being confronted and that with the advancement of technology and the legislative advance it can be very promising.
