DA INSTITUCIONALIZAÇÃO DO DIREITO À DIFERENÇA PARA A TUTELA DA SAÚDE MENTAL DA DIVERSIDADE SEXUAL DE MIGRANTES E REFUGIADOS

Its general objective is to confront the problem of recognizing the right to difference as an indispensable element for the reconstruction and re-signification of power relations in the face of migratory and refuge movements of people in search of the recognition of rights related to sexuality and cultural identity, as a condition for preservation of mental health. Through the deductive method of approach, we start from the imbalance of the dimensions of power in the face of the invisibility of the singularities of people and peoples. It is recognized that among the methodologies for nationalizing heteropatriarchal power is the basis of the unequal situation and without the enjoyment of rights based on the discourse of universality as the basis for equality. However, the naturalization of inequality and the oppression of difference are no longer sustainable in contemporary times, as the intensity and ostensibility of human mobility highlight and reveal the invisible rights to mental health, cultural identity and sexual freedom.
