Trabajo de cuidado no remunerado: un análisis de la desigualdad de género, el reconocimiento jurídico y la redistribución desde un enfoque interseccional

The article analyzes unpaid care work in Colombia as a structural source of gender inequality, from an intersectional approach that makes visible the inequalities and forms of oppression that converge in the experiences of women caregivers. Based on a documentary and analytical-critical methodology, the article examines the normative and jurisprudential advances that have addressed the right to care, taking as a reference Nancy Fraser’s model of justice grounded in the axes of recognition, redistribution, and representation. The findings reveal significant progress in the legal recognition of care as an autonomous fundamental right by the Constitutional Court; however, there are still gaps regarding the guarantee of labor rights, social protection, and shared responsibility among the State, family, and society. It concludes that the consolidation of public policies and regulations with an intersectional approach constitutes an imperative to materialize substantive equality and ensure the autonomy of women caregivers.
