El derecho de libertad de escogencia de profesión u oficio: un análisis crítico de los límites dispuestos por la jurisprudencia de la Corte Constitucional colombiana

This article critically analyzes the fundamental right enshrined in Article 26 of the 1991 Colombian Constitution: the freedom to choose one's profession or trade. From a neoconstitutionalist approach, it examines the limits imposed by the jurisprudence of the Constitutional Court in relation to the State's eventual moral commitments. It incorporates a historical, philosophical, and normative analysis of the functions of the State and the interpretive scope of judgments C-422/05, T-207/10, and C-932/14, among others. It argues that the social and democratic State model of law requires a balance between individual autonomy and the protection of human dignity, and that the Constitutional Court has oscillated between liberal and perfectionist approaches in its rulings. The article concludes with theoretical proposals to strengthen the role of constitutional law as a guiding framework for ethical and inclusive labor policies.
